Parte sosteniendo que Kant no solo incorpora derechos individuales sino que también la idea de soberanía popular. Este pensador considera la democracia, pero un sistema de principios tiene prioridad normativa respecto de la práctica de autolegislación colectiva. Después, el escrito muestra que la teoría democrática habermasiana elabora un argumento similar al kantiano. Por tanto, no reconstruye el balance entre derechos y democracia como pretende sino de forma similar a (...) como lo hace Kant.: This article discusses the Kantian component in the theory of deliberative democracy. It begins claiming that Kant not only incorporates individual rights but also the idea of popular sovereignty: This author values democracy; however, a system of principles has normative priority over the practice of collective self-determination. The text later shows that Habermas’s theory of deliberative democracy elaborates a Kantian justification. This study builds on prior research investigating the antecedents of firm supererogation. Examining vehicle recalls in the U.S. automobile industry from 1966 to 2010 reveals that surveillance-based government enforcement programs can have widespread industry effects on a specific type of supererogatory action, firm volunteerism. Specifically, increases in government surveillance are associated with firms going beyond what is legally required of them by initiating voluntary product recalls for defects not covered in existing government regulation. Such effects are shown to be unique (...) among surveillance efforts as other government enforcement activities, such as standards-based regulation, are revealed to have a negative association with firm supererogation. Corporate social responsibility has an impact on many areas of society, and it has recently been active in the digital space, a growing area of business activity. However, certain factors prevent it from firmly establishing itself in this area. One of these factors is the lack of user trust. Certain instruments have been created to address this issue, such as codes of conduct that seek to mitigate the causes of distrust by making significant improvements in the regulations and ethical standards (...) applicable to business transactions. These instruments are the product of industry self-regulation and complement rather than substitute for effective legal regulations. In light of some European Community directives, European legislators are addressing certain issues in this area, especially unfair business practices. (shrink)

Advertising is a booming activity both in the physical realm and on the Internet. Online advertising is growing and is subject to legal standards, although some self-imposed ethical standards for the industry are needed. This has been called self-regulation. This article examines the important role that self-regulation can play in addressing advertising that uses degrading and discriminatory images of women that compromise their dignity. Sexist advertising is a reification of women—stereotypes and sexist social models—that do not convey a realistic image (...) of a woman’s abilities and potential. This article analyzes specific decisions on the subject issued by the Jury of the Spanish Association for the Self-Regulation of Commercial Communication. The Jury’s decisions are based on a code of ethics. The technical expertise and impartiality manifested in its decisions have produced a high degree of credibility and confidence in the organization. The Texas borderlands have come to be increasingly important in the historical literature and in public opinion for the way that the region shapes national thought on race, borders, and ethnicity. With this increasing importance, it is pressing to examine the history of these issues in the region so that they may be accurately and insightfully deployed. This article contributes to the existing scholarship with a close discursive analysis of race in the booster materials, 1904-1941. The booster materials forge a (...) notion of race relations that borrows from tropes common across the West but is also informed by Jim Crow and the unique demands of the region. The booster materials forward a notion of race that is largely unique in Western boosterism, positing only two major characters, Mexicans and white Northerners. The figure of ‘the Mexican’ is drawn more as a part of nature than human society in that it shares the fundamental characteristics of the land, animals, and rivers of the region. Nature in the region is depicted as an adventitious, disorderly, and wasteful body that calls out for northern discipline. The ‘Northerners’ are figured as the ones who, through applying discipline to the natural resources of the area (land, water, and Mexicans) can bring reason, fertility, and profitable connection to the national economy. The consequences of this racial division are further explored in the article as they play out in schooling, religion, justice, beauty, leisure, and sport. (shrink)

In this article, we focus on what the appropriate law to punish criminals should be in a libertarian society; that is, one that respects the Non-Aggression Principle and property rights. We examine various theories of punishment and explain why some are incompatible with libertarianism. We contribute to the latest libertarian theory of punishment suggesting the necessity to take time preference into consideration. The claim according to which there is a categorial gap between meaning and saying ¿ between what sentences mean and what we say by using them on particular occasions ¿ has come to be widely regarded as being exclusively a claim in the philosophy of language. The present essay collection takes a different approach to these issues. It seeks to explore the ways in which that claim ¿ as defended first by ordinary language philosophy and, more recently, by various contextualist (...) projects ¿ is grounded in considerations that transcend the philosophy of language. More specifically, the volume seeks to explore how that claim is inextricably linked to considerations about the nature of truth and representation. It is thus part of the objective of this volume to rethink the current way of framing the debates on these issues. By framing the debate in terms of an opposition between "ideal language theorists" and their semanticist heirs on the one hand and "communication theorists" and their contextualist heirs on the other, one brackets important controversies and risks obscuring the undoubtedly very real oppositions that exist between different currents of thought. We estimate the effect on business start-ups of a program that significantly speeds up firm registration procedures. The program was implemented in Mexico in different municipalities at different dates. Our estimates suggest that new start-ups increased by about 4% in eligible industries, and we present evidence that this is a causal effect. Most of the effect is temporary, concentrated in the first 10 months after implementation. The effect is robust to several specifications of the benchmark control group time trends. We introduce and consider the inner-model reflection principle, which asserts that whenever a statement \varphi(a) in the first-order language of set theory is true in the set-theoretic universe V, then it is also true in a proper inner model W \subset A. A stronger principle, the ground-model reflection principle, asserts that any such \varphi(a) true in V is also true in some non-trivial ground model of the universe with respect to set forcing. These principles each express a form of width (...) reflection in contrast to the usual height reflection of the Lévy–Montague reflection theorem. They are each equiconsistent with ZFC and indeed \Pi_2-conservative over ZFC, being forceable by class forcing while preserving any desired rank-initial segment of the universe. Furthermore, the inner-model reflection principle is a consequence of the existence of sufficient large cardinals, and lightface formulations of the reflection principles follow from the maximality principle MP and from the inner-model hypothesis IMH. The iconic and diagrammatic features of abduction, as expressed in Peirce’s works after 1890, allow one to re-read the Kantian concept of schema. By means of this new reading, it is possible to consider the dynamics between legality and creative acts, which, according to Emilio Garroni, keep cultures alive. This process can be analysed by a semiotic theory that could combine the features of Kant’s Aesthetic Judgment (as an answer to schema’s problems) and Peirce’s last theory of abduction. In this (...) way, it becomes possible to go beyond the simple subsumption, through Reflective Judgment, of sensible intuitions under a concept. Thus, creativity becomes the process, both mental and cultural, whereby a new regularity come from the background of the previous one as a result of the free play of our faculties (Musement), which sets links between universes of experience apparently very distant one from another. Progressive supranuclear palsy is a movement disorder with prominent tau neuropathology. Brain diseases with abnormal tau deposits are called tauopathies, the most common of which is Alzheimer's disease. Environmental causes of tauopathies include repetitive head trauma associated with some sports. To identify common genetic variation contributing to risk for tauopathies, we carried out a genome-wide association study of 1,114 individuals with PSP and 3,247 controls followed by a second stage in which we genotyped 1,051 cases and 3,560 controls for the (...) stage 1 SNPs that yielded P ≤ 10-3. We found significant previously unidentified signals associated with PSP risk at STX6, EIF2AK3 and MOBP. We confirmed two independent variants in MAPT affecting risk for PSP, one of which influences MAPT brain expression. The genes implicated encode proteins for vesicle-membrane fusion at the Golgi-endosomal interface, for the endoplasmic reticulum unfolded protein response and for a myelin structural component. © 2011 Nature America, Inc. Olympic combat sports are unconventional physical activity strategies to train middle-aged and older people with and without health problems. This systematic review aimed to assess the available body of published peer-reviewed articles related to the effects of Olympic combat sports interventions on health-related quality of life in adults aged 45 and older. The search was carried out in five generic databases until July 2021 and the protocol was registered in PROSPERO. The PRISMA guidelines were followed and the Downs and Black (...) checklist was used to assessed the methodological quality of the studies. After reviewing 1,151 records, only seven studies met the inclusion criteria, adding 212 participants with a mean age of 63.7 years. Six studies provided data to calculate the effect size in the Olympic combat sports groups. Three studies reported beneficial changes with a small ES for the total score of the health-related quality of life. Two studies reported a beneficial change with a small ES and strong ES for physical health. One study reported improvements with a small ES for emotional and functional well-being. In conclusion, interventions based on Olympic combat sports produce beneficial effects with a small and moderate ES on health-related quality of life in male and female aged 45 and older who are healthy participants, participants with Parkinson's disease, and participants with breast cancer.Systematic Review Registration:https://www.crd.york.ac.uk/prospero/, PROSPERO: CRD42021244161. This paper provides a detailed study of David Hilbert’s axiomatization of the theory of plane area, in the classical monograph Foundation of Geometry. On the one hand, we offer a precise contextualization of this theory by considering it against its nineteenth-century geometrical background. Specifically, we examine some crucial steps in the emergence of the modern theory of geometrical equivalence. On the other hand, we analyze from a more conceptual perspective the significance of Hilbert’s theory of area for the foundational (...) program pursued in Foundations. We argue that this theory played a fundamental role in the general attempt to provide a new independent basis for Euclidean geometry. Furthermore, we contend that our examination proves relevant for understanding the requirement of “purity of the method” in the tradition of modern synthetic geometry. (shrink)

The paper outlines an interpretation of one of the most important and original contributions of David Hilbert’s monograph Foundations of Geometry , namely his internal arithmetization of geometry. It is claimed that Hilbert’s profound interest in the problem of the introduction of numbers into geometry responded to certain epistemological aims and methodological concerns that were fundamental to his early axiomatic investigations into the foundations of elementary geometry. In particular, it is shown that a central concern that motivated Hilbert’s axiomatic (...) investigations from very early on was the aim of providing an independent basis for geometry. Accordingly, these concerns about an independent grounding for elementary geometry determined very clear methodological constraints in the process of embedding it into a formal axiomatic system. It is argued that Hilbert not only sought to show that geometry could be considered a pure mathematical theory, once it was presented as a formal axiomatic system; he also aimed at showing that in the construction of such an axiomatic system one could proceed purely geometrically, avoiding concept formations borrowed from other mathematical disciplines like arithmetic or analysis. El artículo presenta y analiza un conjunto de notas manuscritas de clases para cursos sobre geometría, dictados por David Hilbert entre 1891 y 1905. Se argumenta que en estos cursos el autor elabora la concepción de la geometría que subyace a sus investigaciones axiomáticas en Fundamentos de la geometría . Por un lado, afirmo que lo que caracteriza esta concepción de la geometría es: i) una posición axiomática abstracta o formal; ii) una posición empirista respecto del origen de la (...) geometría y de su lugar dentro de las distintas teorías matemáticas. Por otro lado, sostengo que el papel que Hilbert le confiere a la intuición geométrica en el proceso de axiomatización de esta teoría, permite apreciar claramente su oposición respecto de las posiciones formalistas con las que habitualmente es identificado. Sobre la base que aportan las notas manuscritas de David Hilbert para cursos sobre geometría, el artículo procura contextualizar y analizar una de las contribuciones más importantes y novedosas de su célebre monografía Fundamentos de la geometría, a saber: el cálculo de segmentos lineales. Se argumenta que, además de ser un resultado matemático importante, Hilbert depositó en su aritmética de segmentos un destacado significado epistemológico y metodológico. En particular, se afirma que para Hilbert este resultado representaba un claro ejemplo (...) de uno de los rasgos más fructíferos y atractivos de su nuevo método axiomático formal, o sea, la capacidad de descubrir y exhibir conexiones estructurales o internas entre diferentes teorías matemáticas. On the basis of a set of unpublished notes for lecture courses on geometry, the paper seeks to contextualize and analyze one of the most important and original contributions of David Hilbert's celebrated monograph Foundations of Geometry, namely its arithmetic of line segments. It is argued that Hilbert attributed to his arithmetic of segments an important epistemological and methodological meaning, in addition to its relevance as an original mathematical result. In particular, it is claimed that for Hilbert his arithmetic of segments represented a clear example of one of the most fruitful and attractive traits of his new formal axiomatic method, i.e., the power to discover and exhibit inner or structural connections among different mathematical theories. This paper is a reply to Benjamin Smart’s : 319–332, 2013) recent objections to David Armstrong’s solution to the problem of induction : 503–511, 1991). To solve the problem of induction, Armstrong contends that laws of nature are the best explanation of our observed regularities, where laws of nature are dyadic relations of necessitation holding between first-order universals. Smart raises three objections against Armstrong’s pattern of inference. First, regularities can explain our observed regularities; that is, universally quantified conditionals are (...) required for explanations. Second, if Humean’s pattern of inference is irrational, then Armstrong’s pattern of inference is also irrational. Third, universal regularities are the best explanation of our observed regularities. I defend Armstrong’s solution of induction, arguing against these three claims. (shrink)

El artículo presenta una interpretación del abordaje axiomático temprano a la geometría de David Hilbert, i.e., el desarrollado entre 1891 y 1905. Se sostiene que diversos aspectos de este abordaje, a primera vista problemáticos, se pueden comprender mejor si se contrastan con una de sus influencias más importantes en este periodo: la teoría pictórica [Bildtheorie] de Heinrich Hertz. En particular se argumenta que un análisis de la concepción axiomática de Hilbert a la luz de la teoría de Hertz permite (...) aliviar ciertas tensiones en la concepción hilbertiana; más precisamente, las tensiones que surgen de mantener, al mismo tiempo, una posición axiomática abstracta o formal y una concepción empirista de la geometría, que la considera una ciencia natural. El artículo ofrece una interpretación de las contribuciones de David Hilbert a la teoría de las magnitudes poligonales, desarrollada en su influyente monografía Fundamentos de la geometría, publicada en 1899. Se argumenta que la construcción de esta parte central de la geometría euclidiana represento para Hilbert un desafío muy significativo, en razón de su objetivo general de proporcionar una axiomatización estrictamente sintética de esta teoría geométrica; es decir, en virtud de sus conocidos requerimientos metodológicos y epistemológicos de construir la (...) geometría elemental evitando toda apelación esencial a presupuestos numéricos. Se sostiene además que dicho desafío consistió en ofrecer un nuevo fundamento lógicamente sólido para la teoría del área poligonal, pero que al mismo tiempo pueda ser considerado como puramente geométrico. The paper offers an interpretation of David Hilbert's contributions to the theory of polygonal magnitudes, developed in his influential monograph Foundations of Geometry, published in 1899. It is argued that the construction of this central part of Euclidean geometry presented an appealing challenge to Hilbert's general aim of providing a purely synthetic axiomatization of this geometrical theory; in other words, to his epistemological and methodological concerns of constructing elementary geometry without resorting to any kind of numerical assumption. Moreover, it is claimed this challenge consisted in offering a new foundation for the theory of polygonal area, which could be considered at the same time as logically sound and purely geometrical. El artículo examina una de las contribuciones más importantes a los fundamentos de la geometría euclídea elemental lograda por David Hilbert en su obra Fundamentos de la geometría, a saber: la reconstrucción de la teoría euclídea de las proporciones y de los triángulos semejantes. Se argumenta que dicha reconstrucción no sólo estuvo motivada por la identificación de Hilbert de suposiciones implícitas en la teoría de Euclides, sino que además estuvo esencialmente ligada a la preocupación por la 'pureza del método'. Más aún, se afirma que, en este caso específico, el requerimiento de Hilbert por la pureza del método posee un carácter general o fundacional, esto es, no se refiere a la demostración de un teorema en particular, sino más bien es planteado respecto de la construcción axiomática de la teoría misma. Abstract: This paper defends David Armstrong’s solution to the problem of inductionb against Helen Beebee’s attack on that solution. To solve theproblem of induction, Armstrong contends that the timeless necessity explanation is the best explanation of our observed regularities, whereas Beebee attempts to demonstrate that the time-limited necessity explanation is an equally good explanation. Allegedly, this explanation blocks Armstrong’s solution. I demonstrate that even if the time-limited ecessity explanation were an equally good explanation of our observed regularities, this explanation (...) does not block Armstrong’s solution. I argue that, in fact, the timeless necessity explanation is a better explanation of our observed regularities than is the time-limited necessity explanation. (shrink)

In this paper, I attempt to throw some light on modal realism. Since it is David Lewis who has put forward the best arguments for thar position, I focus on his work. In the first, I point out that his approach does not provide an adequate account for the intuitive lack of symmetry between the actual and the possible. To begin with, I try to show that the strategy of appealing to both the spatio-temporal network and causality is not (...) at all satisfactory. Secondly, I criticize the argument for modal realism that is based on theoretical benefits. Then, I defend the view that Lewis' indexical analysis of the concept of actuality does not satisfy his own criterion of acceptability: an analysis of actuality should account for the intuitions about our actual word. I claim thet Lewis' objections to other positions can be raised against his own position. Finally, I conclude that, even though Lewis is right in claiming that actualist conceptions do not explain why the possible is not part of the actual, the realist conception fail to account for the special ontological status that we intuitively grant to our own world. This book is concerned with the role of economic philosophy ("ideas") in the processes of belief-formation and social change. Its aim is to further our understanding of the behavior of the individual economic agent by bringing to light and examining the function of non-rational dispositions and motivations ("passions") in the determination of the agent's beliefs and goals. Drawing on the work of David Hume and Adam Smith, the book spells out the particular ways in which the passions come to (...) affect our ordinary understanding and conduct in practical affairs and the intergenerational and interpersonal transmission of ideas through language. Concern with these problems, it is argued, lies at the heart of an important tradition in the British moral philosophy. This emphasis on the non-rational nature of our belief-fixation mechanisms has important implications: it helps to clarify and qualify the misleading claims often made by utilitarian, Marxist, Keynesian, and neo-liberal economic philosophers, all of whom stress the overriding power of ideas to shape conduct, policy, and institutions. This discussion paper is a reply to Stathis Psillos’ paper “Induction and Natural Necessities” :327–340, (2017), published in this journal. In that paper, he attempts to refute David Armstrong’s solution to the problem of induction. To accomplish this desideratum, he proposes that the best explanation for our observed regularities is a sort of “best before date” necessity. That is, necessary connections may break down and are not by default timeless. He develops arguments against my :67–82, (2014) defence of the (...) necessitarian solution regarding a previous paper by Beebee :504–527, 2011.. He alleges that best before date necessity is no worse than timeless necessity; his proposal does not imply any further inductive generalisation to timeless necessity; and inductive inferences are justified. In this discussion paper, I provide arguments against these three claims. (shrink)

Los últimos avances de la ciencia invitan a pensar en la posibilidad práctica del transhumanismo. Pero quizá es pertinente estudiar una pregunta a la que todavía ni la ciencia ni la filosofía han sabido dar respuesta. En concreto, la naturaleza de la consciencia fenoménica de Ned Block o del concepto de vigilancia de Stanislas Dehaene. Pese a los últimos avances en neurociencia y en inteligencia artificial, seguimos sin pistas para responder a la pregunta del problema fuerte de la consciencia de (...) David Chalmers, del como y por qué estamos aquí. Somos capaces de discriminar de que información somos conscientes, pero no hemos conseguido averiguar por qué somos conscientes o como se genera esa consciencia. El problema es mas grave de lo que parece, ya que no somos capaces de medir, definir ni replicar la consciencia fenoménica. Sin medición, si el objeto de estudio es subjetivo y cualitativo, no se puede aplicar el método científico. Luego, pese a que podríamos replicar la información de nuestro cerebro en un artefacto mecánico, nada garantiza que nuestra consciencia fenoménica se replique ahí, ya que no podemos medir la consciencia fenoménica. Este artefacto hecho a imitación nuestra podría no ser mas que un zombie filosófico, en palabras de David Chalmers, un ser sin consciencia fenoménica, un ser sin alma. Ante esta realidad, cabe preguntarnos: ¿es seguro explorar la alternativa de trascender en un sistema independiente de nuestro cerebro biológico, como un ordenador, sino tenemos ninguna herramienta para medir si ese sistema puede ser consciente de si mismo o producir consciencia fenoménica como un epifenómeno? Si la respuesta, como se defiende en este trabajo, es negativa, una alternativa mas segura para el transhumanismo es explorar la ingeniería genética, los implantes artificiales o embeber el cerebro en sistemas artificiales. I assess Tamar Gendler's (2007) account of self-deception according to which its characteristic state is not belief, but imaginative pretense. After giving an overview of the literature and presenting the conceptual puzzles engendered by the notion of self-deception, I introduce Gendler's account, which emerges as a rival to practically all extant accounts of self-deception. I object to it by first arguing that her argument for abandoning belief as the characteristic state of self-deception conflates the state of belief and the process (...) of belief-formation when interpreting David Velleman's (2000) thesis that belief is an essentially truth-directed attitude. I then call attention to the fact that Velleman's argument for the identity of motivational role between belief and imagining, on which Gendler's argument for self-deception as pretense depends, conflates two senses of 'motivational role'-a stronger but implausible sense and a weaker but explanatorily irrelevant sense. Finally, I introduce Neil Van Leeuwen's (2009) argument to the effect that belief is the practical ground of all non-belief cognitive attitudes in circumstances wherein the latter prompt action. I apply this framework to Gendler's account to ultimately show that imaginative pretense fails to explain the existence of voluntary actions which result from self-deception. (shrink)

O presente artigo analisa as críticas que o jovem Nietzsche dirigiu à concepção de arte vigente na cultura alemã da segunda metade do século XIX, em particular as críticas apresentadas em O nascimento da tragédia e na Primeira consideração intempestiva. Longe do potente significado que a arte possuía nas tragédias de Ésquilo e Sófocles, a arte moderna, diante da “seriedade da existência” e na esteira da tendência de Eurípides, seria apenas representação de uma cultura vazia e sem substância. Se entre (...) os gregos do período de Sófocles, a arte possuiria um sentido existencial profundo, na modernidade, ela apareceria como mero instrumento de distração e entretenimento. Como procuraremos demonstrar, o filósofo da Basileia salienta inclusive a pobreza de sentido e a torção semântica que as obras de grandes compositores como Beethoven, Haydn e Wagner teriam adquirido nas mãos de determinados tipos humanos tomados como referência na época. Segundo ele, mesmo quando os filisteus da cultura [Bildungsphilister] se referiam aos grandes artistas ou gênios, em tom supostamente elogioso, eles assim o faziam de forma equivocada e canhestra. Assim, buscando ressignificar e redimensionar o papel da arte na cultura alemã moderna, Nietzsche critica o exaltado escritor da época David Strauss, enxergando nele uma espécie de modelo humano ou expressão lapidar da cultura filistina.
